Contract for the Supply of Products or Services
The display of goods on the site amounts to an invitation to treat only and is not an offer to sell products or services at any price indicated. No contract for the supply of products or goods will be deemed to exist between you and TOPDEC unless, and until, an email is sent by TOPDEC to you confirming that your order has been accepted and payment has been successfully made.
This confirmation e-mail amounts to an acceptance by TOPDEC of your offer to buy goods or services from TOPDEC and this acceptance is effective regardless of whether or not you receive the e-mail.
 

TOPDEC are free to withdraw from a prospective contract at any time prior to acceptance. This also applies in the case of any error or inaccuracy in respect of the goods or services, any description applied to the goods or services, the availability of the goods or services, or the order itself.

Mixed Colours & Colour Matching – Terms & Conditions

All colours are tinted using our professionally calibrated tinting equipment, programmed and maintained in accordance with the paint manufacturer's specifications. Colour matches are produced using the manufacturer's approved formulations, recognised colour standards, colour cards, or customer-supplied samples.

Whilst every effort is made to achieve the closest possible colour match, an exact match cannot be guaranteed due to factors including, but not limited to:

• Differences in paint brands, formulations and sheen levels.

• Variations between production batches.

• Ageing, weathering or fading of existing paintwork.

• Surface texture, porosity and substrate colour.

• Lighting conditions, both natural and artificial.

• Digital images or photographs not accurately representing colours.

Before You Start Painting

Customers must always complete a test area before proceeding with the full application. This should be carried out on the actual surface, allowed to dry fully, and assessed under the lighting conditions in which the finished project will be viewed.

Do not continue with the application if you are dissatisfied with the colour. Once paint has been applied beyond a test area, it is deemed accepted by the customer.

Returns & Refunds

As all tinted and colour-matched paints are produced specifically to your order, they are non-returnable and non-refundable, except where there is a verified manufacturing defect or product fault.

We cannot accept returns or provide refunds for:

• A colour not meeting personal expectation or preference.

• Slight colour variations between brands, batches or sheen levels.

• Colours that appear different under varying lighting conditions.

• Incorrect colours selected or ordered by the customer.

• Colour differences when matching aged, weathered or previously painted surfaces.

• Paint that has already been applied beyond an initial test area.

Customer Responsibility

By placing an order for a tinted or colour-matched product, the customer acknowledges and accepts that:

• The colour will be manufactured as close as reasonably possible using the available tinting technology.

• Minor colour variation is an accepted part of the tinting and colour matching process.

• A test area must be completed and approved before full application.

• The product is a bespoke item and is therefore not eligible for return or exchange unless found to be faulty.

 

Topdec BOXED service

 

• Subscription– you can subscribe to Topdec Boxed from your desktop, tablet, mobile or android device.

• Membership– Topdec Boxed is a rolling 1 month contract (subject to the exclusions set out below) and is only available to individuals residing in the UK.

• Availability- Topdec Boxed is available for delivery to UK addresses, postcode restrictions apply. This service may take 3 – 5 working days & longer to these areas; Highlands & Islands of Scotland, Shetlands.

• Orders– you must place your order online. It is your responsibility to select your preferred eligible delivery service. We aim to have your order fast shipped on a next day service but this may take longer.

• Delivery- Topdec reserves the right to alter the delivery service valid in this promotion at any time; in this case you will be offered the delivery service available at that time free of charge.

• Cancellation - You can cancel your Topdec Boxed subscription within 14 days of subscribing by contacting Topdec via phone 01442 440696 or via email, brian@topdecbrush.com

• Membership - You are responsible for using Topdec Boxed in accordance with the terms and conditions. Any breach will result in termination of your membership and no refund will be given. Topdec reserves the right to accept or refuse membership and to change any terms and conditions at its discretion. Topdec will inform you of any significant changes to these terms and conditions. All other applicable Topdec terms and conditions apply.

• Personal use only- Topdec Boxed is for personal use only.

• Delay outside of our control- Topdec will not be held responsible for any delay or failure to comply with our obligations if the delay or failure arises from any cause which is beyond Topdec's reasonable control.

• Termination- We may decide to terminate your Topdec Boxed account and you will be given a refund based date. We will not give any refund for termination related to conduct that we determine, in our discretion, violates these terms or any applicable law, involves fraud or misuse, or is harmful to Topdec's interests or another user.

 

You are required to have ‘prior permission’ to use, borrow or display ANY photograph or text from this site.

Copyright statement – Our photographs are not licensed for gain, commercial or public use or use in the public domain.
Requests for usage of copyrighted materials should in the first instance be submitted to Topdec Decorating Supplies (A Fee will apply).
